Do you need a permit for a fence in San Jose?
It depends on the project. San Jose exempts some fences from a building permit and requires one for the rest1; the exemption's limit is 7 feet (for side and rear yards; on corner lots, only sides not along the street), with the conditions in the city's wording below.

Depends on size or scope
San Jose's rule“A building permit is not required to construct a fence or retaining wall unless the project exceeds the maximum heights set forth in the municipal code.”1

Which permits you need
| Permit | Required when | The city’s wording |
|---|---|---|
| Building permit | Fence higher than the height limits | If the fence is higher than these limits, you must apply for both a building permit and a planning permit.1 |
| Zoning permit or review | Fence higher than the height limits (planning permit) | If the fence is higher than these limits, you must apply for both a building permit and a planning permit.1 |
Limits and conditions in San Jose's rule
Each limit sits next to the sentence it comes from; the conditions in that sentence are part of the rule.
| Rule | Value | The city’s wording |
|---|---|---|
| Exempt up to this height | 7 feet, for side and rear yards; on corner lots, only sides not along the street | Fences, other than swimming pool barriers, not over seven feet (2,134 mm) high.2 |
| Retaining walls exempt up to | 2 feet, for walls measured from existing grade that are also no more than 4 feet from the bottom of the footing | If the retaining wall is greater than 2 feet in height as measured from existing grade, a building permit is required and other permits are required as follows…1 |
| Exempt height along the street | 3 feet, for the front yard, and on corner lots the side yard along the street | Front yard along the street - 3 feet maximum…1 |
| Retaining walls exempt up to, under the building code (the wording covers retaining walls) | 4 feet, for walls measured from the bottom of the footing, with no surcharge, that are also no more than 2 feet above existing grade | Retaining walls which are not over four feet (1,219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or III-A liquids.2 |
Zoning rules: separate from the building permit
A project can be exempt from one and still need the other (zoning vs building permits).
| Zoning rule | Value | The city’s wording |
|---|---|---|
| Maximum height in the front yard | 3 feet | Front yard - 3 feet maximum…1 |
| Maximum height in side and rear yards | 7 feet | Rear yard - 7 feet maximum…1 |
