How New Jersey adopts building codes

N.J.S.A. 52:27D-119 et seq.; N.J.A.C. 5:23

  • Statewide; applies everywhere. The Act provided for a single, mandatory construction code and for a fundamental restructuring of the enforcement process.4
  • All of New Jersey. This subchapter provides a uniform system of construction standards throughout the State through the adoption of model codes applicable throughout the State.3
  • Commissioner adopts the code. The commissioner shall after public hearing pursuant to section 4 of the “Administrative Procedure Act,” P.L.1968, c.410 (C.52:14B-4) adopt a State Uniform Construction Code for the purpose of regulating the structural design, construction, maintenance, and use of buildings or structures to be erected and alteration, renovation, rehabilitation, repair, maintenance, removal, or demolition of buildings or structures already erected.6
  • 3 years. Adoption of publications shall not occur more frequently than once every three years; provided, however, that a revision or amendment may be adopted at any time in the event that the commissioner finds that there exists an imminent peril to the public health, safety, or welfare.6
  • Effective August 17, 2026. Effective Date: August 17, 2026.2
  • 6 months. For a period of six months following the operative date of a subcode revision, applicants may submit a complete permit application, including all prior approvals, to be reviewed under the code in force immediately preceeding the subcode revision.5
  • Prior local construction rules superseded. All construction regulations incorporated in any act of the State of New Jersey, or of any municipality presently in effect, or validly promulgated or enacted by any board, department, commission or agency thereof shall continue in effect until such time as any such regulation is superseded by appropriate regulations promulgated pursuant to this act, at which time they shall be deemed repealed and superseded, and of no further force and effect.6
  • Zoning and trade licensing unaffected. Nothing contained in this act or the code shall be deemed to affect, repeal or invalidate local zoning ordinances or the regulation or licensing of any trade or profession engaged in construction work.6
  • Intent to eliminate local construction regulations. Intent is elimination of construction regulations by local government units.7
  • Municipal fire safety maintenance codes allowed. …a municipality or the commissioners of a fire district pursuant to N.J.S. 40A:14-81 may adopt and provide for the enforcement of a fire safety maintenance code or continue to enforce an existing fire safety maintenance code.6
Applies to
All of New Jersey3
